The Cycle Tube Case: Second day’s hearing at Birmingham: Mr. Commissioner Darling, Q.C., and a special jury resumed the hearing this morning in the Nisi Prius Court at Birmingham Assizes of the important cycle tube case: The action was brought by Messrs. Larson and Larson, merchants, Edmund Street, Birmingham against the Endurance Seamless Tube Company. Limited to recover payment for goods supplied. Defendants admitted liability but counterclaimed for damages for breach of contract by reason of the goods being of bad quality and unfit for the purpose for which they required them. Mr. H. D. Green, Q.C., M.P., and Mr. Stubbins (instructed by Messrs. Reece and Harris) appeared for the plaintiffs; and Mr. H. Young and Mr. Parfitt (instructed by Messrs. Birmingham Assizes: Coventry Libel and Slander Action: … Alleged Breach of Contract: As announced in our column on Monday, Henry Hulme, a farmer living at Baginton brought an action against Messrs. Rider, Betts and Son, grain merchants, Coventry for damages for breach of contract. Mr. Hugo Young (instructed by Messsrs. Smith, Pinsent, and Co.) was for the plaintiff, and Mr. Stanger, Q.C. with whom was Mr. Parfitt (instructed by Messrs. Hughes and Masser, Coventry,) for the defendants….  The Jury found a verdict for the plaintiff, fixing the damages at £40 …

Birmingham & Aston Chronicle: Saturday 4th December 1896

A Solicitor Struck off the Rolls: In the Queen’s Bench Division on Monday before Baron Huddleston and Mr. Justice Manisty, Mr. Wills applied on behalf of Mr. Bernard Gilpin of Longford, Cannock, to strike a solicitor, practicing at West Bromwich, off the rolls. Applicant deposed in his affidavit that, in 1878, the solicitor in question acted for him in two matters, one a mortgage Transaction and the other a sale of property, and in or about July of that year he was entrusted by applicant with three sums of money, amounting in all to £38, for payment to other persons. Recently Mr. Gilpin discovered that the solicitor had not paid money, and he had had to pay the amounts over again. Mr. Pinsent, of the firm of Barlow, Smith and Pinsent, solicitors, Birmingham deposed to applying, on behalf of the applicant, for the money, and threatening proceedings: and their clerk deposed to serving the solicitor with notice of the proceedings. The name of the solicitor was not mentioned in court, and he did not appear either personally or by counsel. — His name was struck off the rolls.

Dunlop: This action, which was one to restrain Mr. Dunlop from parting with his interest in the Fleuss and Smallman Patents to the Tubeless Pneumatic Tyre Company, and which was appealed to the House of Lords, has been abandoned by the Pneumatic Tyre Company, who have also signified their intention to withdraw the action altogether: Official information of this was given to the Tubeless Pneumatic Tyre Company, by Messrs. Smith, Pinsent, and Co., of Bennett’s Hill, solicitors for the defendant.
