Evening Despatch: Thursday 4th September 1902

Income-Tax Assessment: At a meeting of the Birmingham Chamber of Commerce, held yesterday, Mr. F. B. Goodman in the chair, a discussion took place with reference to income tax assessment. The chairman said it was a very different question, and one which would require a great deal of time if it was to be thoroughly investigated. He suggested the matter should be referred to a small committee consisting of Messrs. R. A. Pinsent, Eric Carter. and H. C. Field. Mr. W. H. Edmunds seconded the motion and regretted that the Council had not moved in the matter earlier. The resolution was carried.

Birmingham Weekly Post: Saturday 16th August 1902

Birmingham Solicitor and the Naval Review: Before Master Archibald, on Monday, in the King’s Bench Division, a suit was heard, brought by Mr. R. A. Pinsent, solicitor, of Birmingham, against the Cooperative Cruising Company, Limited, and Dr. Henry S. Lunn. The case was on the summons for judgment under Order 14 for the return of £50 12s, balance of £54, 12s, paid by the plaintiff for passage money for four berths on the S.S. Pretoria for the naval review cruise on June 27th, which cruise had been cancelled owing to the postponement of the review. The defendant company had tendered £40. 9s. 7d, the amount due under their booking conditions, which sum the plaintiff was willing to accept on condition that the costs of the writ issued by him were paid by the defendant. The defendant company argued that, having regard to their booking conditions, the writ was prematurely issued, and that the costs should be borne by the plaintiff. The Master, without calling upon counsel for the defendants, decided that the action was premature, and that the costs both of the writ and of the subsequent proceedings must be paid by the plaintiff.

A Naval Review Lawsuit: The following case, which is of interest to persons who booked for the last naval review, was heard before Master Archibald yesterday in the King’s Bench Division. The plaintiff was Mr. R. A. Pinsent, solicitor, of Birmingham, and the defendants the Co-operative Cruising Company Limited and Dr. Henry S. Lunn. The action was for the return of £50 12s, balance of £54 12s paid by the plaintiff for passage money for four berths on the s.s. Pretoria, for the naval review cruise on June 27th, 1902, which cruise had been cancelled owing the postponement of the review. The defendant company had tendered £40 9s. 7d, the amount due as they declared under their booking condition, which sum the plaintiff was willing to accept on condition that the costs of the writ issued to him were paid by the defendants. The company argued that having regard to their booking conditions the writ was prematurely issued, and that the costs should be borne by the plaintiff. The Master, having heard plaintiff’s counsel, without calling upon counsel for the defendants, decided that the action was premature, and that the costs both of the writ and of the subsequent proceedings must be paid by the plaintiff.

The defendant company had tendered £40 9s 7d, the amount due under their booking conditions, which sum the plaintiff was willing to accept on condition that the costs of the writ issued by him were paid by the defendants. The defendant company argued that, having regard to their booking conditions, the writ was prematurely issued, and the costs should be borne by the plaintiff, as the defendant company and Dr. Lunn had used the greatest expedition in settling the accounts connected with this cruise. The Master, having heard plaintiff’s counsel, without calling upon counsel for the defendants, decided that the action was premature, and that the costs of both the writ and the subsequent proceedings must be paid by the plaintiff.
