A Question of Costs: Before Master Archibald yesterday, in the King’s Bench Division, a case was down for judgement under Order 14, for the return of £50 12s, balance of £54 12s paid by Mr. R. A. Pinsent for passage money for four berths on the S.S. Pretoria for the Naval Review Cruise on Jun 27, 1902, which cruise had to be cancelled owing the postponement of the review. The defendants, the Co-operative Cruising Company Limited, and Dr. Henry S. Lunn, had tendered £40 9s 7d, the amount dure under their booking conditions, which sum the plaintiff was willing to accept on condition that the costs of the write issued by him were paid by the defendants. The defendant company argued that having regard to their booking conditions the writ was prematurely issued, and that the costs should be borne by the plaintiff, as the defendant company and Dr. Lunn had used the greatest expedition in getting the accounts connected with this cruise. The master having heard the plaintiff’s counsel, Mr. E. M. Pollock, without calling upon counsel for the defendant, Mr. Montague Shearman, decided that the action was premature, and that the costs both of the writ and of the subsequent proceedings must be paid by the plaintiff. …

Birmingham Daily Post: Thursday, December 7th, 1871: Issue 4178

Birmingham Law Students’ Society: A meeting of this society was held at 21 Bennetts Hill, on Tuesday evening last; Mr. W.H. Rosher, barrister presiding. The subject for discussion was Moot Point 485: – “A.B. bought a house from C.D.’s agent, who, on being asked at the time of sale, stated that the drainage was perfect. C.D. knew the drainage was very bad, but his agent was ignorant of the fact. Can A.B., maintain an action against C.D. for damages for fraud or misrepresentation?” Mr. W. Johnson opened in the affirmative and was supported by Messrs. Adams and Parish. Mr. Wilson replied in the negative; Messrs. Pinsent, Van Ward and Rowlands speaking on the same side: The Chairman summed up at considerable length and declared the voting to be in favour of the affirmative by one. A vote of thanks to the Chairman terminated the proceedings.

The Birmingham Law Students’ Society: A meeting of this society was held at the society’s room, No 21 Bennetts Hill, on Tuesday evening; Mr. G.T. Smith in the Chair. After the ordinary business had been transacted, a vote of thanks was passed to the late honorary secretary, Mr. Thomas Bishton, for his courteous and efficient services. It was announced that Mr. Herbert W. Stanbury had been elected by the committee as honorary secretary, and Mr. Canning as honorary librarian. The subject for debate was “In the case of Lord Dunraven v Llewellyn, the Court of Exchequer Chamber held that there was no general common law right of tenants of manor to common on the waste. Was the decision in accordance with the authorities cited by the Court?” The speakers on the affirmative were Messrs. Parish, Canning, and Pinsent; on the negative, Messrs. W. Johnson and A. Van Wart. The voting was in favour of the negative. At the conclusion of the debate the honorary secretary announced Mr. G.J. Johnson had kindly consented to deliver a lecture at the next meeting of the society.
